Copyright and Trademark Policy

BirthdayQuest values and respects the intellectual property rights of all creators, businesses, partners, and users. As a marketplace platform, BirthdayQuest does not own or create vendor content directly. We take copyright and trademark protection seriously, and we will respond promptly to valid legal notices regarding alleged infringement

We may remove or temporarily disable content while a claim is reviewed. We also reserve the right to suspend, restrict access, or terminate accounts that repeatedly infringe the copyrights or trademarks of others, or who knowingly submit false or fraudulent claims.

If you believe that material posted on, submitted through, or otherwise accessible through BirthdayQuest’s products, applications, websites, or services infringes your copyright or trademark rights, you may submit a notice of infringement to hello@birthdayquest.com. Your written notice must include the following information:

(a) Your physical or electronic signature, confirming you are the copyright or trademark owner or are authorized to act on behalf of one;

(b) (i) For copyright: a description of the copyrighted work claimed to have been infringed; or

(ii) For trademark: a description of the trademark claimed to be infringed, including basis of rights (registration number, country/jurisdiction, and associated goods/services categories);

(c) Clear identification of the material you believe is infringing, including specific URL(s) or direct location in BirthdayQuest’s platform;

(d) Contact information for the rights holder: name, title, address, telephone number, and email;

(e) A good faith statement that the disputed use is not authorized by the IP owner, its agent, or by law; and

(f) A statement, made under penalty of perjury, confirming accuracy of the information provided and that you are authorized to act on behalf of the owner of the exclusive right allegedly infringed.

By submitting an infringement notice, you acknowledge and agree that BirthdayQuest or its designated agent may forward the information contained in your notice to the user responsible for the allegedly infringing content.

Counter-Notice Procedure

If your material was removed or disabled due to an infringement notice, and you believe the material is not infringing or you have legal authorization to use and display it, you may submit a counter-notice to hello@birthdayquest.com. Your counter-notice must include:

  1. Your physical or electronic signature;
  2. Identification of the content removed or disabled, including where it was located before the removal or disabling;
  3. A statement, under penalty of perjury, of your good faith belief that the material was removed or disabled due to mistake, misidentification, or an incorrect claim;
  4. Your name, physical address, and telephone number, plus your consent to the jurisdiction of the Federal District Court of your address (or any judicial district where BirthdayQuest may be found, if outside the United States), and agreement to accept service of process from the person who submitted the original infringement notice or their agent.

If the claimant does not file an action seeking court restraint within ten (10) business days of receiving your counter-notice, BirthdayQuest may reinstate the content.

Fraudulent Claims Notice

Submitting false, abusive, misleading, or bad-faith infringement notices or counter-notices may result in account suspension or termination and potential legal liability.
